On the List of Goods Requiring 
Sanitary and Phytosanitary-SPS Compliance Certification Prior to Import and Export
 
- According to Decree on the Organization and Operation of Ministry of Industry and Commerce no.275/PM, dated 1 September 2023;
- According to Decree on Import and Export no.114/GOV, dated 6 April 2011;
- According to the request letter of the Department of Foreign Trade no.1606/DFT, dated 25 April 2024.
 
Minister of Industry and Commerce has issued a Decision:
 
Article 1 Objectives
 
This Decision is situlated to determine the list of goods which requires Sanitary and Phytosanitary (SPS) compliance certificatation  prior to import and export.
 
Article 2 List of goods which requires SPS Compliance Certification prior to import and export
 
List of goods which requires SPS compliance certification prior to import and export are those goods that need to get certification on quality, testing or inspecting in compliance with regulations of each sector and to comply with SPS.

Remark: 
For goods listed in the table of this Decision that has not been determined its HS Code or already determined but it is not clear or incompleted, the related sectors shall coordinate with customs administration for clssifying the HS code of the actual goods correctly and be consistent with details of the goods according to the Hamonized Tariff Nomencrature. 
Article 4 List of Goods requring SPS Compliance Certification Prior to Export
 
List of Goods which requires SPS Compliance Certification Prior to Export is to follow the rules of destination country and treaties that Lao PDR is a party. 
 
Article 5 Amendment of List of Goods Requiring SPS Compliance Certification Prior to Import
 
Amendment of list of goods reguiring SPS compliance certification prior to import is to 
add or remove goods in the list as specified in Article 3 of this Decision. 
Amendment of the list each time must be approved by Minister of Industry and Commerce following the study and request of related sectors. 
Upon finishing the amendment, Ministry of Industry and Commerce shall notify related sectors for acknowlegment and implemetation.  
 
Article 6 Submission of an application for SPS Compliance Certification Priort to Import and Export
 
Importer or Exporter must submit an application to related sector prior to import or export 
goods each time according to list of goods specified in the table of this Decision with a complete and correct document according to reuglations of related sectors. 
 
Article 7 Implementation
 
Department of Foreign Trade, Ministry of Industry and Commerce is assigned to cooperate with related sectors in order to disseminate and implement this Decision for good outcomes.
 
Article 8 Effectiveness
 
This Decision is effective from the date of signaure and published in the Lao Gazette.
