Decision
On the Adoption of Lists of Managed Goods for Temporary Import, Temporary Export, Import for Re-Export and Transit
- According to Decree on the Organization and Operation of Ministry of Industry and Commerce no.604/PM, dated 15 October 2021;
- According to Decree on Import and Export no.114/GOV, dated 6 April 2011;
- According to Order on Facilitation of Import and Export, Temporary Import, Transit and Movement of Goods in Lao PDR no. 12/PM, dated 16 October 2019.
- According to the request letter of Department of Import and Export no.1806/DIMEX, dated 23 June 2023.
Minister of Industry and Commerce has issued a Decision:
Article 1 List of Goods for Temporary Import, Temporary Export, Import for Re-Export and Transit
Ministry of Industry and Commerce has agreed to adopt lists of managed goods for temporary import, temporary export, import for re-export and transit that are divided into thress lists as follows:
1. Goods Requiring to apply for a License Prior to Temporary Import, Temporary Export, Import for Re-Export and Transit (Annex 1);
2. Goods Prohibited for Temporary Import, Temporary Export, Import for Re-Export and Transit (Annex 2);
3. Goods Reserved for Temporary Import, Temporary Export, Import for Re-Export and Transit (Annex 3).
Article 2 Goods Requiring to apply for a License Prior to Temporary Import, Temporary Export, Import for Re-Export and Transit
Goods requiring to apply for a license prior to temporary import, temporary export, import for re-export and transit are goods that are in the management list of related sectors and must be authorised from that sector before carry out temporary import, temporary export, import for re-export and transit with a purpose to follow, inspect, manage the use correctly with its objective and to prevent the illicit import for distributing domestically, ensuring that the goods will be export to overseas or re-import as specified under the laws, regulations of Lao PDR and Treaties that Lao PDR is a party and related international agreements.
Article 3 Goods Prohibited for Temporary Import, Temporary Export, Import for Re-Export and Transit
Goods that are prohibited for temporary import, temporary export, import for re-export and transit are goods that are not allowed for tempoary import temporary, tempoary export, import for re-export, and transit in the territory of Lao PDR with a purpose to protect national securtiy, social order, evironment protection or to comply with the conventions that Lao PDR is a party.
Article 4 Goods Reserved for Temporary Import, Temporary Export, Import for Re-Export and Transit
Reserved goods are goods that are not permitted to be temporarily imported, temporarily exported, imported for re-export or transited in the territory of the Lao PDR for a certain period of time as determined by the government, with the aim of reducing the impact on the socio-economic development of the country, protecting the environment, and human and animal health.
Article 5 Conditions, Procedures and Supporting Documents to Apply for a License
Conditions, procedures and documents to apply for a license to temporarily import, temporarily export, import for re-export and transit of managed goods shall be in accordance with the Decision on Temporary Import, Temporary Export of Managed Goods No. 0230/MOIC.DIMEX, dated 25 March 2021 and the Decision on the Management of Transited Goods No. 0451/MOIC.DIMEX, dated 14 June 2021.
Article 6 Amendment of List of Managed Goods for Temporary Import, Temporary Export, Import for Re-Export and Transit
Amendments of the list of managed goods for temporary import, temporary exports, imports for re-export and transit each time shall be approved by the Minister of Industry and Commerce on the basis of research and animous agreement from the relevant sectors that manage such goods.
Article 7 Implementation
Department of Import and Export, Ministry of Industry and Commerce is assigned to coordinate with relevant sectors in the implementation of this Decision with high effectiveness.
Article 8 Effectiveness
This Decision is effective upone the signature date 45 days upon the signing and publishing in the Lao Official Gazetter.
