Order on Enhancing the Agricultural Production to Replace the Import and become the Export Goods

Pursuant to Resolution of National Assembly on the Endorsement of National Agenda in order to Resolve the Financial-Economic Crisis No.03/NA, dated 10 Agust 2021.
Pursuant to Resolution of Lao PDR Government on Sharing of Responsibilities in term of Implementing the Resolution of National Assembly to Resolve the Financial-Economic Crisis No.07/GOV, dated 4 October 2021.
Pursuant to Decree of Prime Minister on The Organization and Implementation of Ministry of Agriculture and Forestry No.603/PM, dated 15 October 2021.
Pursuant to the Discussion with Relevant Department, Institution and the Presentation of Permanent Secretary Office of Ministry of Agriculture and Forestry dated 14 October 2021.
 
      In order to implement the national agenda for addressing the financial-economic crisis during 2021-2023, the agriculture and forestry sector shall take the intention for implementing two key elements. Enhancing the agricultural production to replace import and reduce the foreign currency be transferred overseas. As well as, encouraging the agricultural production which is related to goods processing to be exported overseas in terms of taking the foreign currency to the country. Aiming to maintain the level of agricultural growth estimated 2.5% per year by focusing on the production of paddy rice not less than 3.5 million tons per year. This including the production of rice for food security 2.5 million tons, rice for stocking 400,000 tons, rice for plant variety 100,000 tons. The rest of production will be as a raw material for domestic industry factory and goods for export global markets. Grow plants such as vegetable, taro, potato, sweet corn, fruit in 261,710 hectares per year and 2.12 million ton per year. Focus on the production of meat, fish and egg estimated 531,000 tons and the rate of consumption to reach 69.8 kilogram per person/year. Focus on the producing the plant, soil, fertilizer and animal feed which can be process. Produce the agriculture to become goods for export to reach 3.6 billion US dollar within 3 years or 1.2 billion US dollar per year including the export value of agriculture 1.1 billion US dollar per year and the export value of livestock 0.1 billion US dollar per year. To reach these targets.
 
Minister of Agriculture and Forestry issued the Order:
 
1. Focus on supporting the agricultural production in order to replace import, reduce the outflow of foreign currency as below:
1.1. The department of agriculture and department of livestock and fisheries shall continue to promote and protect domestic producers to be strong and stable by enhancing the implementation of non tariff measures such as strictly implement sanitary and phytosanitary measures (SPS), technical barriers to trade measures (TBT) in order to reduce the import of goods which can be produced in domestic. Plants or animals which have not had the SPS agreement between Lao PDR and trading partner countries, those shall be prohibited to import by defining the list of plants, animals and aquatic animals which will be reduced for import in more detail. Moreover, continuing to advertise, disseminate, encourage the society to consume more domestic agricultural products. 
1.2. The department of agriculture shall encourage to support the agricultural production according to clean, safety and green agriculture. Improve the quality and standard of production such as standard of clean agriculture and good agriculture (OA, GAP) which trading partner countries can accept and is safety for domestic consumption.
1.3. The department of livestock and fisheries shall establish the projects to enhance the production of pig, fish and poultry in order to replace the import and support the agricultural production according to good agriculture, improve the quality and standard of production such as the standard of livestock and poultry (GAHP, GAQP) which trading partner countries can accept and is safety for domestic consumption.
1.4. The department of forestry shall collaborate with relevant agencies and department of agriculture and forestry in provincial or Vientiane capital. As well as, support and facilitate to grow timber, wood to be goods for supplying to factory in the country. Reducing the import of timber, wood which is related to job creation and employment in the country according to the potential of actual circumstance.
1.5. The department of agriculture land management shall encourage, support and strengthen farmers and operators to produce and use organic fertilizer, fertilizer and soil in domestic. In order to enhance the capacity of domestic production to be sufficiency, reduce and terminate the import of fertilizer and soil which can be produced in the country.
1.6. The department of technical promotion and agriculture processing, forestry research and rural development institution shall continue to improve the institutions, stations by assigning the authorities to work at those institutions and stations where are the producing areas and supply the plants. As well as those areas can be the educational place and provide the technical knowledge to farmers, operators in order to produce goods according to technique, standard, access to the market requirements. Recheck the demand of tools, equipment for producing, agricultural machines which are innovation to reduce the cost of production.
1.7. Agriculture, forestry research and rural development institution, biotechnology and ecology institution, department of livestock and fisheries, department of forestry shall continue to research on plants types, animal types, industry timber types, flowering tree-ornamental trees and fruit trees. Promoting the reproduction of tissue by using biotechnology and writing the project proposal in detail for each type of plants, the quantity of demand, quantity of production which already had, the number of productions which needs to produce more, where will produce and who will produce?
1.8. The department of planning and finance shall collaborate with technical departments to create the conditions, factors and environments which will facilitate the production such as access to low interest rate of loan, the information of market demand in each period, policy of promotion and investment for domestic production by continuing to implement thirteen policies for rice and plants, eight policies for animal and aquatic animals.
2. Focus on supporting the agricultural production and processing of goods which Lao PDR has a potential and markets in term of taking more foreign currency to the country as below:
2.1. The department of planning and finance shall collaborate with relevant technical departments and local in order to revise the mechanism of cooperation with internal and external operators to produce according to the lists which have been signed the protocols of SPS with trading partner countries (with China 8 items of plants and 1large animal, Vietnam 16 plants, Thailand 15 plants) including the list of plants which finished the pest risk analysis. Moreover, supporting to grow timber, wood to supply domestic processing factories, supporting and encouraging the farmer families, small, medium, big enterprise of internal and external, especially the investors from friendship countries who come to process the production, service by using modern technique-technology to produce the high value of agriculture production and promote the investment by 2+3 format and other formats. Focusing on the analysis of project management such as PIP project, ODA project and foreign direct investment to encourage the implementation of national agenda and response to the request of relevant departments. Moreover, continue to establish and improve the statistic and data collection to be covered to local which can monitor the movement weekly and monthly and be as the secretariat to monitor and report to the ministry in each period.
2.2. The department of agriculture land management shall continue to allocate agriculture lands 4.5 million hectare across the country in order to ensure the areas are sufficient and suitable with ecosystem of plants each type (rice, commercial crops/industry crops, food crops/vegetable, fruit…) and live animals by collaborating with relevant agencies and local. Speed up the land allocation and establish the production reserve areas for commercial plants which are priority and already access to the markets in term of responding to small, medium and big enterprise. Moreover, establishing and revising the regulations to manage and develop the agriculture lands to be consistent with circumstances and conditions of development.
2.3. The department of forestry shall coordinate with the department of agriculture and forestry in provincial or Vientiane capital and relevant agencies to collect the data of production for export and research for writing the project, defining the implementation measures including the support policies which are related to plant production to become goods for export by focusing on the areas which are allocated to produce the agriculture for export as defined by relevant departments. Continuing to negotiate to sign the protocol of SPS with China, Thailand, and Vietnam and continuing to negotiate to open the technique market of plants and animal products with other countries.
2.4. The department of livestock and fisheries shall continue to establish and implement the project of cow production and other types of animals which have the potential to export by focusing in the northern provinces of Lao-China railway corridor, east-west economic corridor (Laos-Vietnam, Laos-Thailand) and provinces which have the potential to produce the agriculture. Continuing to encourage the trading partner countries to negotiate on trading animals and animal products with Lao PDR officially.
2.5. The department of forestry shall continue to cooperate with relevant sectors to discussion on conversion of debt to be fund. Moreover, focusing on research the regulations which are related to revenue sharing, which receives from changing the three types of forest to be the other types, to forest protection fund. Researching and acknowledge the regulations of government which are related to timber exploration including the request of exploration and collection of dried timber previously. Coordinating with relevant sectors in detail about the request of timber planting on 200,000 hectares, how to be approved and allocated to operators? How many to allocate to each company? Where? Will be suitable by taking into account of many factors including the establishment of timber processing factory in domestic. Collaborating with forestry inspection department to prepare the plan for assigning the authorities to work at the site office of each area of three types of forest in order to manage, protect each type of forest to be effective and ensure the project of carbon selling with overseas.
2.6. The department of agriculture, department of livestock and fisheries, department of forestry, department of forestry inspection and department of technique promotion and processing agriculture shall coordinate with relevant sectors and local to speed up the management, promote and develop the processing industry of agriculture-forestry factory in order to produce and supply to domestic market and export overseas. Researching and improving the procedures and relevant regulations which are related to trade and export agricultural and forestry products to be short and cut off the procedures which are not necessary.
2.7. The department of technique promotion and processing agriculture shall coordinate with relevant agencies to improve and strengthen the production in term of enhancing the products by making a priority of producing goods, joint economy by establishing the organization for producing (production group, association and new cooperative) to facilitate the support of accessing to fund and the market information.
2.8. The department of irrigation shall focus on supporting the construction, repair, fix and manage the use of irrigation project which already exist across the country to supply water for agriculture production areas for two seasons as planned, as well as to ensure the drought and flood.
3. The department of agriculture and forestry in provincial shall focus on key works as below:
3.1. Plant and animal quarantine in local and traditional border checkpoint shall strengthen to monitor, inspect the export across the borders in accordance with Law on the protection and plant quarantine No.13/NA, dated 15 November 2016, Law on livestock and veterinarian (revised) No.08/NA, dated 11 November 2016, Regulation on sanitary and phytosanitary of pants and animals or plants-animals quarantine of destination country. As well as, focusing on the implementation of Guidance of ministry of finance No.3708/MOF, dated 16 September 2019 on the management of import-export of goods, items via the local and traditional border checkpoint. Moreover, focusing on the data collection of import-export agriculture-forestry products in order to provide the information weekly, monthly.
3.2. Advertise and disseminate the information of plant and animal lists which need the technical negotiation for opening the market and the related SPS conditions of plants and animals to private sector for transforming the border trade to international trade.
3.3. Recheck the economic-technique analysis of private sector who operates the business of agriculture-livestock or buying of plants-animal products to export. To encourage the operator proceeds in accordance to technique and principle of clean agriculture. The operator shall have the sale contract with trading partner in overseas and have the organization for producing. The processing of plant-animal products in province shall have a clear and complete task to be consistent with the priority list of plants-animals and conditions of SPS for plants-animals which are defined by trading partner when import.
3.4. Support all types of production, especially farm producing and using the technique. Collaborate with line departments to define the areas for growing and treating as appropriated. 
3.5. Collect the information of farmers and the capacity of production in order to define the development plan and balanced abilities for producing and supplying by local.
3.6. Monitor the implementation of all tasks and report the progress to ministry in each period. 
4. Assigned to the permanent secretariat, departments and institutions, agriculture and forestry department in provincial, Vientiane capital across the country to implement this Order effectively. Moreover, the department of inspection is assigned to be as a key agency in order to monitor, check and report the implementation of each sector as assigned. By implementing if have any advantages or disadvantages, those shall be summarized, evaluated, lesson learned and report to minister of ministry of agriculture and forestry in each period (3, 6 or 12 months) to consider and solve immediately.
5. This Order is effective since the date of signature.
