Pursuant to Decision on Export-Import and Transit of Food No 1166/MoH, dated 21 June 2018, any person or organization that breaches this decision, shall be subject to re-education, warned, fined depending on the seriousness of the offense, as follow:
1. First offense against measures in this decision, as follow:
- Offense in Article 20.1, Article 20.2, Article 25, Article 35.4, Article 35.6 and Article 35.10, an offender shall be warned and committed.
- Offense in Article 35.3, an offender shall be warned, committed and fined 2,5 million Kip.
- Offense in Article 35.1, 35.2 and 35.5, an offender shall be warned, committed and fined 5 million Kip.
- Offense in Article 35.7 to 35.9, an offender shall be warned, committed and fined 5 million Kip with seizing upon products.
2. Second offense against measures in this decision, as follow:
- Offense in Article 20.1, Article 20.2, Article 24, Article 35.4, Article 35.6 and Article 35.10, an offender shall be warned and committed and fined 1 million Kip
- Offense in Article 19, an offender shall be warned, committed and fined double of a value of products based on market price.
- Offense in Article 35.3, an offender shall be warned and committed and fined 5 million Kip.
- Offense in Article 35.1, Article 35.2, Article 35.5, an offender shall be warned and committed and fined 10 million Kip and suspended temporarily for 06 months to 12 months.
- Offense in Article 35.7 to 35.9, an offender shall be committed and fined 10 million Kip, seize upon products and suspended temporarily for 06 months to 12 months.
3. Third offense against measures in this decision, as follow:
- Offense in Article 20.1 to 20.2, Article 24, Article 25, Article 35.4, Article 35.6 and Article 35.10, an offender shall be warned and committed and fined 5 million Kip and suspended temporarily for 06 months to 12 months.
- Offense in Article 19, an offender shall be warned and committed and fined quadruple of value products based on market price.
- Offense in Article 35.5, an offender shall be warned and committed and fined 10 million Kip and suspended temporarily for 06 months to 12 months.
- Offense in Article 35.1, Article 35.2 and Article 35.5, an offender shall be fined 15 million Kip and suspended permanently.
- Offense in Article 35.7 to 35.9, an offender shall be fined 15 million Kip, seize upon products and suspended permanently for 06 months to 12 months.
Any entrepreneur breaching the measures mentioned above, whether it is the first and second third Offense, a serious violation of principles causing damage to life and the economy is to be prosecuted according to the laws. Therefore, it requires that entrepreneurs shall aware and follow the rules, regulations, notifications, and laws related to their own business operations in order to avoid any loss.
